Export Control Compliance

Albert Einstein College of Medicine complies with federal export control laws and regulations that pertain to the conduct and dissemination of our research and to the export of tangible items including equipment, components, and materials. Compliance with U.S. export control laws is the responsibility of all Einstein faculty, students, and staff. If you have any questions about export controls, please contact the Office of General Counsel at ogc@einsteinmed.edu for assistance in determining what laws and regulations apply to your research or other activities.

Export Compliance Policy and Program

Einstein’s export compliance program facilitates compliance with U.S. export control laws, while balancing our commitment to openness in research and education.

Required Training

  • All Einstein employees and all Einstein faculty employed by Einstein or Montefiore are required to complete the Introduction to Export Compliance module through the CITI program.
  • In addition, all principal investigators on grants or IRB protocols also are required to complete the Export Compliance for Researchers module.
  • Courses can be accessed at citiprogram.org using Montefiore Einstein AD credentials.

What Are Export Controls?

Export control laws govern how we transfer or transmit certain technology, materials, data and information to anyone overseas as well as to foreign nationals on U.S. soil. When activities involve specified technologies, Einstein may need to obtain federal approval before allowing the following activities:

  • Allowing foreign nationals to participate in research
  • Partnering with a foreign company
  • Traveling with technology to specific countries
  • Shipping items to specific places or sharing items with specific people
  • Sharing research results in any manner (including publication or presentation at conferences) with persons who are not U.S. citizens or permanent residents

Penalties for non-compliance are severe and impact both the institution and the researcher. If an investigating agency determines an export control violation has occurred, an individual may be subject to civil and criminal penalties, and Einstein may be subject to, among other penalties, debarment from government contracts.

Fundamental Research Exclusion

Most Einstein research activities are excluded from export controls due to the Fundamental Research Exclusion. 

Activities that Require Export Control Guidance

Export Controls apply to many activities at Einstein that you might not expect. For example, entering into a contract with people listed on certain government lists or sending money to certain countries, may require a license from the U.S. government, or shipping certain items, such as inert plasmids to foreign destinations, may involve complying with export control laws.
